Terms and Conditions for Admission and Services at Elderly Heaven 1 LLC Effective Date: 0 1/01/2020 These Terms and Condition govern the relationship between [Elderly Heaven 1 LLC] (the "Facility") and the individual receiving care services (the "Resident") and/or the Resident’s legal representative (the "Responsible Party"). By signing this Agreement, the Resident or Responsible Party acknowledges and agrees to the following terms and conditions: 1. General Information 1.1 Facility Name and Location The Facility is located at Stonecrest, Georgia 30038. It is licensed by the Georgia Department of Community Health (DCH) to provide personal care services. 1.2 Facility Services The Facility offers personal care services, which may include assistance with activities of daily living (ADLs), such as bathing, dressing, grooming, medication management, and supervision. Additional services may be available as outlined in the Resident's Service Plan. 2. Admission and Eligibility 2.1 Admission Requirements To be admitted to the Facility, the Resident must meet the following criteria: The Resident is at least 18 years of age. The Resident does not require 24-hour medical care that can only be provided in a skilled nursing facility. The Resident is able to participate in their care planning and activities or has a legal representative to do so on their behalf. 2.2 Resident Assessment Upon admission, an initial assessment of the Resident’s physical, emotional, and social needs will be completed by the Facility. This assessment will form the basis of the Resident’s Service Plan. 2.3 Right to Refuse Admission The Facility reserves the right to refuse admission to any individual who does not meet the eligibility requirements or whose needs cannot be adequately met by the Facility. 3. Fees and Payment 3.1 Fee Structure The fees for personal care services are outlined in the attached Schedule of Fees. These fees may vary depending on the level of care required and the services provided. 3.2 Payment Terms Fees are due on the 1st of each month, unless otherwise agreed upon. The Facility accepts payment by Paypal, Zelle, and SOURCE and CCSP program. A late fee of $150 may be charged for payments received after the due date. 3.3 Non-Refundable Deposit A non-refundable deposit of $500 is required upon admission to secure the Resident’s place at the Facility. This deposit will be credited toward the first month’s payment. 3.4 Insurance The Resident or Responsible Party is responsible for obtaining and maintaining any insurance coverage (e.g., Medicaid, long-term care insurance) to cover the cost of services. The Facility will cooperate with the Resident or Responsible Party to verify insurance coverage and billing. 3.5 Financial Responsibility The Resident and/or Responsible Party is financially responsible for all charges incurred during the Resident’s stay, including any additional services requested that are not covered by insurance or included in the standard fee. 4. Resident Rights and Responsibilities 4.1 Resident Rights The Resident has the right to: Receive respectful, dignified care. Participate in the development of their Service Plan. Have privacy and confidentiality regarding personal, medical, and financial information. Be free from abuse, neglect, and exploitation. Make decisions regarding their care, including the right to refuse treatment. 4.2 Resident Responsibilities The Resident is expected to: Provide accurate and complete information about their health and personal needs. Cooperate with the Facility staff in the development and implementation of their Service Plan. Maintain proper conduct and respect for other residents, staff, and Facility property. Pay fees and costs in a timely manner as outlined in this Agreement. 4.3 Emergency Situations In the event of a medical emergency, the Facility will make every effort to contact the Responsible Party and seek immediate medical attention as necessary. The Resident’s physician and emergency contacts will be notified. 5. Discharge and Termination 5.1 Voluntary Discharge The Resident or Responsible Party may request discharge from the Facility at any time, provided a 30 days written notice is given. 5.2 Involuntary Discharge The Facility reserves the right to discharge the Resident under the following circumstances: The Resident’s needs exceed the care capabilities of the Facility. The Resident’s behavior poses a danger to themselves or others. The Resident fails to pay fees as agreed upon, despite reasonable attempts to resolve the issue. The Facility is unable to continue providing services due to unforeseen circumstances. 5.3 Discharge Procedure In the event of discharge, the Facility will work with the Responsible Party to ensure a smooth transition to another appropriate care setting. 6. Health and Safety 6.1 Health Care and Medical Services The Facility does not provide medical care but will coordinate with the Resident’s physician for medical appointments, prescriptions, and health needs. Residents are encouraged to maintain regular visits with their primary care provider. 6.2 Medications The Facility will assist in the administration of medications as prescribed, provided the Resident has consented to medication management services. All medications must be provided in their original prescription containers. 6.3 Safety and Security The Facility maintains safety and security measures to ensure the well-being of all residents. This includes fire safety, fall prevention, and other measures as required by Georgia state regulations. 7. Confidentiality and Privacy 7.1 Confidentiality of Personal Information The Facility respects the privacy and confidentiality of all personal and medical information. This information will only be shared with the Resident’s consent or as required by law. 7.2 Access to Records The Resident or Responsible Party has the right to access the Resident’s personal records upon request, in accordance with applicable privacy laws and regulations. 8. Governing Law This Agreement is governed by the laws of the State of Georgia. Any disputes arising from this Agreement shall be resolved in the courts located in Dekalb County, Georgia.

Policies and Procedure

1. Admission Policy Purpose: To ensure fair, consistent, and clear guidelines for the admission of residents to the facility, ensuring all individuals receive appropriate care and services. Policy: Eligibility Criteria: Residents must be 65 years or older, or younger if they require assistance with activities of daily living (ADLs) due to chronic illness, injury, or disability. Medical Evaluation: A comprehensive medical evaluation by a licensed healthcare provider is required before admission. This includes current medications, health status, and functional abilities. Admission Process: Potential residents must complete an application form. A meeting will be scheduled with the family and/or responsible party to assess the suitability of the facility. Upon acceptance, a personal care agreement outlining the terms of stay, services provided, and fees will be signed. Trial Period: Residents may be placed on a 30-day trial period to assess compatibility with the facility’s care capabilities. 2. Resident Rights and Responsibilities Purpose: To protect the dignity, privacy, and well-being of all residents, while encouraging responsibility for their actions and participation in their care. Policy: Resident Rights: Residents have the right to be treated with dignity, respect, and consideration. Residents are entitled to make their own decisions about their daily life, care preferences, and activities, to the extent they are able. The facility will respect residents' privacy and confidentiality regarding personal, medical, and financial information. Residents have the right to communicate freely with family, friends, and healthcare providers. Residents have the right to voice grievances or concerns without fear of retaliation. Resident Responsibilities: Residents are expected to comply with facility rules, including safety and health protocols. Residents are encouraged to participate in social and recreational activities, to promote mental and emotional well-being. 3. Care Services Policy Purpose: To ensure that all residents receive high-quality, individualized care that meets their physical, emotional, and social needs. Policy: Personal Care Services: Assistance with ADLs such as bathing, dressing, grooming, eating, and mobility will be provided as needed. Staff will assist with medication management, including medication reminders and administration. Healthcare Services: Residents will have regular medical evaluations by licensed healthcare providers. The facility will maintain records of all medical visits and any changes in health conditions. Nutrition and Meal Services: Residents will receive nutritious meals tailored to their dietary needs (e.g., diabetic, low-sodium, gluten-free diets). Residents may have input into meal choices where feasible. Mental and Emotional Support: Counseling and mental health services will be made available as needed. Activities will be designed to encourage social interaction, cognitive engagement, and emotional well-being. 4. Health and Safety Policy Purpose: To ensure the health and safety of all residents and staff by minimizing risks and promoting a safe environment. Policy: Infection Control: The facility will adhere to stringent infection control protocols, including regular hand hygiene, sanitization of common areas, and isolation procedures for residents with contagious conditions. Vaccination policies will be followed to protect against common illnesses (e.g., flu, pneumonia). Emergency Procedures: Clear emergency evacuation plans will be posted throughout the facility. Regular fire drills and safety checks will be conducted to ensure staff readiness. Falls Prevention: Resident rooms and common areas will be designed to minimize the risk of falls, with handrails, non-slip flooring, and good lighting. Regular assessments of residents' mobility and fall risk will be conducted. Medication Management: Medications will be stored securely and administered by trained staff. Medication records will be maintained, and any changes in medications will be reported to the resident’s physician. 5. Staffing and Training Policy Purpose: To ensure that all staff are qualified, trained, and capable of delivering high-quality care and services. Policy: Staff Qualifications: All staff members must have appropriate certifications or qualifications in accordance with local regulations (e.g., certified nursing assistants, licensed practical nurses). Background checks will be conducted on all staff before employment. Training Requirements: Staff will receive ongoing training in areas such as resident care, emergency procedures, infection control, and communication with elderly individuals. Annual refresher courses will be provided on topics including dementia care, mental health, and customer service. Staff-to-Resident Ratio: The facility will maintain a sufficient staff-to-resident ratio to ensure each resident’s needs are met in a timely and safe manner. Staff will be available 24/7 to address resident needs. 6. Grievance and Complaints Policy Purpose: To provide a clear process for resolving complaints or grievances in a fair and timely manner. Policy: Filing a Complaint: Residents or their families may submit complaints or concerns to the facility’s management in writing or through a designated grievance hotline. Complaints will be acknowledged within 48 hours and addressed within 7 business days. Investigation and Resolution: A thorough investigation will be conducted into the complaint, and a resolution will be offered to the concerned party. If the complaint is not resolved satisfactorily, residents or their families may appeal to a regulatory body or seek third-party mediation. 7. Visitor and Family Involvement Policy Purpose: To foster strong relationships between residents and their families while ensuring a safe and comfortable environment for all. Policy: Visiting Hours: Visitors are welcome during regular visiting hours (e.g., 9:00 AM – 7:00 PM), and families will be notified of any changes in these hours. Visits outside of normal hours may be arranged on a case-by-case basis. Visitor Guidelines: All visitors must sign in at the front desk and follow infection control procedures (e.g., hand sanitization, mask-wearing if required). Visitors are expected to behave respectfully and in accordance with the facility’s rules to ensure a comfortable environment for all residents. 8. Discharge and Transfer Policy Purpose: To ensure a smooth and respectful transition when a resident is discharged or transferred to another care facility. Policy: Discharge Criteria: A resident may be discharged if their care needs exceed the facility's capabilities, or if the resident voluntarily chooses to leave. Non-payment or failure to comply with facility policies may also result in discharge, with prior notice. Transfer to Other Facilities: In cases where residents require a higher level of care (e.g., hospitalization, skilled nursing), the facility will assist with the transfer process to an appropriate facility. Family members will be notified in advance, and care coordination will be handled by facility staff. 9. Financial Policy Purpose: To establish clear, transparent financial practices for the facility and its residents. Policy: Fee Structure: Fees will be clearly outlined in the resident agreement, including any additional charges for special services. The facility accepts payment via insurance (if applicable), Medicaid/Medicare (if applicable), or private funds. Payment Terms: Monthly fees are due on the 1st of each month. Late payments may incur a fee as outlined in the resident agreement. A deposit may be required upon admission to secure a resident’s spot in the facility. Refunds and Cancellations: Refunds for prepaid fees will be issued on a pro-rata basis if a resident leaves the facility before the end of a billing cycle. 10. Privacy and Confidentiality Policy Purpose: To protect the privacy and confidentiality of all resident information in accordance with applicable laws. Policy: Confidentiality: All personal, medical, and financial information regarding residents will be kept confidential and shared only with authorized individuals or entities. HIPAA Compliance: The facility will comply with all local and federal privacy laws, including HIPAA (or its equivalent) for healthcare privacy and information security.
